These Terms and Conditions apply to services, repairs, vehicle servicing, MOT-related services, the supply of parts and accessories, and vehicle sales undertaken by Maintrack Services Ltd trading as Regency Garage (“Regency Garage”, “we”, “us” or “our”).

By placing an order or booking work with us, you (“the Customer”, “you” or “your”) agree to the terms applicable to that transaction. The agreed quotation, job instruction, work authorisation, vehicle order or other written agreement will form part of the contract.

Nothing in these Terms and Conditions affects any statutory rights you may have under applicable law.

1. General conditions

1.1. These Terms and Conditions apply to consumer and business customers, except where a provision applies only to one category of customer.

1.2. Before work commences or a vehicle sale is concluded, we will provide or agree the relevant description of the work or goods, the applicable price or pricing basis, and any material conditions specific to the transaction.

1.3. Any variation to an agreed quotation, order or scope of work must be agreed between us and the Customer, except where the law provides otherwise.

1.4. If any provision of these Terms and Conditions conflicts with a specific written agreement signed or otherwise accepted by both parties, the specific agreement will take precedence to the extent of the conflict.

1.5. If any provision is found to be unlawful or unenforceable, the remaining provisions will continue to apply so far as legally permitted.

2. Repairs, servicing and workshop services

2.1 Booking and authorisation

We will provide an estimate or quotation for the agreed work wherever reasonably practicable. The scope of work, estimated price and any relevant limitations will be recorded on the job instruction, estimate or other written authorisation.

A quotation is based on the information and faults reasonably identifiable at the time. Diagnostic work may be necessary before the full extent and cost of a repair can be established.

We will not undertake additional chargeable work, or order additional parts at your expense, without obtaining your authorisation. If further work is required, we will explain the reason, any additional cost and any likely effect on the completion time.

You may authorise work in person, by telephone, email or another agreed method. We recommend retaining written confirmation of any additional authorisation.

2.2 Completion times

We will use reasonable care and skill and make reasonable efforts to complete work within the estimated timescale.

Completion dates and times are estimates unless expressly agreed as guaranteed in writing. Delays may arise from diagnostic findings, parts availability, supplier delays or other circumstances beyond our reasonable control. We will keep you informed of material delays and discuss any appropriate next steps.

Nothing in this clause removes any legal remedy available to you if we fail to perform our contractual obligations.

2.3 Parts, oils and consumables

Unless otherwise agreed, replacement parts will be new and of original equipment (OE) standard or equivalent quality appropriate to the vehicle and the work.

Where an alternative part is proposed, we will explain its nature and obtain your agreement before fitting it.

Specialist oils, manufacturer-specific fluids, long-life spark plugs, pollen filters and other additional service items may incur extra charges where these are not included in the agreed service package. We will explain and agree any additional charge before proceeding.

2.4 Removed parts

Where reasonably practicable, removed parts will be made available for inspection if requested before collection of the vehicle. Parts subject to warranty returns, exchange arrangements, environmental requirements or other legal restrictions may need to be retained.

Unless you request otherwise in advance and we agree that the parts can be released, removed parts may be disposed of or returned to suppliers after the work is completed.

Any exchange-part deposit or surcharge will be explained in advance, including the conditions and timescale for its refund.

2.5 Vehicle condition and personal belongings

You should remove valuables and personal belongings before leaving your vehicle with us. Please tell us about any existing damage, security concerns, warning lights or other relevant conditions.

We will take reasonable care of your vehicle while it is in our custody. We are responsible for loss or damage to the extent that it results from our negligence, breach of contract or other legal responsibility.

We do not accept responsibility for loss or damage merely because it occurs on our premises; liability will be determined in accordance with applicable law.

2.6 Customer-supplied parts

We may decline to fit parts supplied by a Customer if their suitability, quality, safety or compatibility cannot be established.

Where we agree to fit customer-supplied parts, we cannot provide a parts warranty for those parts. We remain responsible for our own workmanship and other obligations imposed by law.

If a supplied part is faulty, incompatible or unsuitable, additional labour, diagnostic or removal costs may arise. We will explain any foreseeable additional charges and obtain authorisation where required.

2.7 Existing manufacturer or third-party warranties

Please tell us before work begins if your vehicle is subject to a manufacturer, extended or third-party warranty.

We will discuss any relevant requirements and, where applicable, obtain the necessary authorisation before carrying out work that is to be claimed under another warranty.

We cannot guarantee acceptance of a claim by a third-party warranty provider. We are not responsible for a warranty provider's decision where that decision is outside our control, but this does not exclude any liability arising from our own acts or omissions.

3. Payment, collection and storage

3.1 Payment terms

Unless otherwise agreed in writing, payment is due when the work is completed and the vehicle is ready for collection, or on delivery of goods.

Accepted payment methods are cash, bank transfer, debit card and credit card, subject to any reasonable payment arrangements notified to you before the transaction.

All prices and additional charges will be made clear before you become liable for them. Prices will state whether VAT is included or payable in addition, as applicable.

3.2 Deposits and special orders

We may require a deposit or advance payment for special-order parts, non-stock items or vehicle orders. The amount and purpose of any deposit will be confirmed before payment.

Special-order goods may be non-returnable to our supplier. However, this does not automatically remove any statutory cancellation, refund or other rights you may have.

Any restocking or handling charge must be disclosed in advance, must be reasonable and must be lawful in the circumstances.

3.3 Outstanding payments

Where payment is overdue, we may pursue the amount lawfully due, together with any interest or recovery costs that we are legally entitled to claim.

For business customers, contractual interest and reasonable recovery costs may apply where agreed and permitted by law. For consumers, no interest or charge will be imposed unless there is a lawful basis for doing so.

We may retain possession of a vehicle while properly exercising any lawful lien for sums due in connection with it. We will not sell, dispose of or otherwise transfer ownership of a customer's vehicle except where we have a lawful right to do so and have complied with all applicable legal requirements and notices.

3.4 Vehicle collection

You should collect your vehicle promptly once we notify you that the work is complete.

Where a vehicle is not collected within one calendar day after notification of completion, we may apply a storage charge of £25 plus VAT per day, provided that the charge and the circumstances in which it applies have been disclosed in advance and the charge is lawful and reasonable.

Where practicable, we will notify you before storage charges begin. If collection is delayed for a reason attributable to us, or because we have not made the vehicle reasonably available, we will not charge for that delay.

Any collection or storage arrangements agreed in writing with a company director will take precedence over this clause.

4. Parts and accessories sales

4.1. We aim to supply parts and accessories that meet the relevant vehicle manufacturer's specifications or the agreed description.

4.2. You are responsible for providing accurate vehicle details, including registration, make, model, engine variant and any other information reasonably required to identify the correct part. We will exercise reasonable care when advising on compatibility based on the information supplied.

4.3. If goods are faulty, damaged, misdescribed or otherwise fail to meet the requirements of applicable law, you will retain your statutory rights to an appropriate remedy.

4.4. Where goods have been correctly supplied and a Customer requests a return for convenience, we may agree to accept the return at our discretion. Any handling or restocking charge must be agreed in advance and must not unlawfully restrict statutory rights.

4.5. Special-order, electrical, fitted, used or made-to-order parts may be subject to specific return conditions, which will be explained before the order is placed. These conditions cannot override any mandatory consumer rights.

4.6. Exchange units must be returned in the condition specified when the exchange arrangement was agreed. Any refundable surcharge, return deadline and deductions for damage or missing components will be explained at the time of sale.

4.7. Queries about an invoice should be raised promptly, quoting the invoice number, so that we can investigate. Any request to raise a query within three working days is an administrative request only and does not remove statutory rights or prevent a valid claim outside that period.

5. Vehicle sales

The following conditions apply to vehicles sold by Regency Garage. The individual vehicle order, invoice, written description, any agreed part-exchange valuation and any express warranty will also form part of the contract.

5.1 Vehicle description and condition

The vehicle will be supplied in accordance with the description, specification and express promises set out in the sales documentation.

We will disclose material information about the vehicle's known condition as required by law. You should review the vehicle description, mileage, service history, known defects, included equipment and any agreed preparation work before completing the purchase.

Any inspection you carry out, or any defects specifically disclosed and fairly agreed, will be taken into account only to the extent permitted by law. Nothing in these terms excludes your statutory rights.

5.2 Deposits and orders

Any deposit, reservation fee or other advance payment will be documented, including the circumstances in which it may be retained or refunded.

An order is subject to acceptance by Regency Garage. The agreed sales documentation will set out the vehicle, purchase price, deposit, estimated delivery or collection date, and any agreed conditions.

5.3 Delivery and collection

We will use reasonable efforts to make the vehicle available on the agreed date. If a delay occurs, we will inform you and discuss the available options.

Where a legally applicable delivery deadline is missed, your rights to require delivery, cancel the contract or obtain a refund will be determined by the contract and applicable law.

If you do not collect a vehicle when agreed, we will contact you to arrange collection and discuss any reasonable, previously disclosed costs that may arise. Any cancellation, deposit retention or claim for loss must be lawful and proportionate to the circumstances.

5.4 Part exchange

Where a used vehicle is accepted as part of the purchase price:

  •

You confirm that you have disclosed relevant information about its ownership, mileage, condition, accident history, finance, modifications and known faults.

  1.

You must have the right to transfer ownership or disclose any outstanding finance or third-party interest.

  1.

The part-exchange vehicle must be delivered in substantially the agreed condition, allowing for any changes expressly accepted by us.

  1.

The agreed valuation and any deductions, settlement of outstanding finance and payment arrangements will be recorded in writing.

  1.

Any change in the part-exchange valuation must be justified by the agreed terms and relevant changes in condition, information or circumstances; no automatic reduction will apply unless lawfully agreed.

Ownership of the part-exchange vehicle will transfer in accordance with the written agreement and applicable law.

5.5 Manufacturer price changes and vehicle availability

If a vehicle or associated goods become unavailable, or a material price or specification change occurs before delivery, we will notify you and explain the available options.

We will not impose an unagreed price increase or materially change the vehicle supplied without a lawful contractual basis and any consent required from you.

5.6 Ownership and risk

Ownership of a vehicle or goods will transfer in accordance with the contract and applicable law, including any lawful retention-of-title provision.

Risk in a vehicle sold to a consumer will transfer in accordance with applicable law. Payment, delivery, ownership and risk are separate matters and will not be treated as interchangeable where the law distinguishes between them.

5.7 Vehicle warranties

Any warranty included in the vehicle sale will be described in the sales documentation. A manufacturer's or third-party warranty may also apply on its own terms.

No warranty wording in our documents limits your statutory rights concerning the vehicle.

6. Our workmanship warranty

6.1. In addition to your statutory rights, Regency Garage offers a parts and labour warranty for qualifying repair work for three months or 5,000 miles from completion of the work, whichever occurs first, unless a different written warranty is expressly agreed.

6.2. The warranty covers qualifying replacement parts supplied by us that become defective during the warranty period and associated workmanship where the defect is attributable to that work.

6.3. The warranty does not automatically cover unrelated faults, normal wear and tear, consumables, pre-existing defects, misuse, accident damage, unauthorised alterations or failures caused by other defective components. Any exclusion must be relevant to the claim and consistent with statutory rights.

6.4. Where a problem arises, you must give us a reasonable opportunity to inspect the vehicle and, where appropriate, carry out remedial work. Please contact us promptly and avoid unnecessary use of the vehicle if it may be unsafe.

6.5. The warranty may require compliance with applicable maintenance instructions and reasonable operating requirements. We will explain any specific warranty conditions at the time the work is authorised.

6.6. Where a manufacturer's warranty applies to a particular part, its terms may also be relevant. We will explain any material differences before or when the part is supplied.

6.7. The warranty is additional to, and does not replace or restrict, your statutory rights. Any transfer of the benefit of the warranty to a subsequent owner will be subject to the written warranty conditions.

7. Courtesy vehicles

7.1. A courtesy vehicle may be provided at our discretion, subject to availability and a separate loan agreement.

7.2. Unless otherwise agreed in writing, the driver must:

  •

Hold a valid full driving licence and meet the minimum age and driving-history requirements imposed by the relevant insurer.

  1.

Arrange his/her own comprehensive insurance with no more than £350.00 ADXS (deductible) specifically for the loan car provided.

  1.

Provide the licence and any identification or other documents reasonably required for insurance purposes.

  1.

Comply with the vehicle loan agreement, road traffic laws and any insurance conditions.

  1.

Return the vehicle at the agreed time and in the agreed condition, with the required fuel level.

  1.

Pay any properly incurred fines, tolls, charges, damage costs or other amounts for which the driver is legally responsible.

7.3. Any excess, mileage restriction, permitted-driver limitation, fuel requirement and return condition will be explained before the vehicle is released.

7.4. We may refuse or withdraw a courtesy vehicle where it is unavailable or the applicable insurance requirements are not met. We will not do so in a way that unlawfully excludes any other contractual or statutory obligation.

8. Cancellation and changes to bookings

8.1. Please contact us as soon as possible if you wish to cancel or amend a booking or order.

8.2. For workshop work, you may cancel subject to the terms of the contract and applicable law. Where work has been properly authorised and already performed, you may be required to pay for work completed and parts or costs properly incurred up to cancellation, where legally recoverable.

8.3. Special-order parts and goods are subject to the return and cancellation conditions explained before ordering, together with any statutory cancellation rights.

8.4. Certain contracts concluded online, by telephone or away from business premises may be subject to a statutory cancellation period. Where applicable, we will provide the required cancellation information. If you ask us to start a service during a cancellation period, any required express request and acknowledgement will be obtained.

8.5. Cancellation of a vehicle sale, retention of a deposit and any claim for losses will be governed by the vehicle order and applicable law. No blanket provision automatically forfeits a deposit in every circumstance.

8.6. If we need to cancel or materially change a booking, we will inform you as soon as reasonably practicable and discuss an appropriate refund, rearrangement or other remedy where applicable.

9. Liability

9.1. We will perform our services with reasonable care and skill and will comply with our other contractual and legal obligations.

9.2. Nothing in these Terms and Conditions excludes or restricts liability where such exclusion or restriction is prohibited by law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any statutory consumer right that cannot lawfully be excluded.

9.3. We are not responsible for loss caused by circumstances for which we are not legally responsible. Any limitation of liability will apply only to the extent permitted by law and will not deprive a consumer of a remedy required by statute.

9.4. We are not responsible for a pre-existing fault or an unrelated mechanical or electrical failure merely because it becomes apparent while a vehicle is in our premises. However, we remain responsible where the loss or damage results from our breach of contract, negligence or other legal responsibility.

9.5. Customers must tell us about any known vehicle defects, security issues or special handling requirements that could materially affect the work.

9.6. Any liability limitation applicable to a business customer must be interpreted in accordance with the relevant contract and applicable law.

10. Insurance work and subcontracting

10.1. If repairs are connected with an insurance claim, you remain responsible for any payment that you have agreed to make, subject to the applicable contract and law.

10.2. We are not responsible for delays caused by an insurer's inspection, approval, authorisation or payment where those matters are outside our reasonable control. We will keep you informed of material delays.

10.3. We may engage appropriately qualified subcontractors to carry out part of the work. We will remain responsible for our own contractual obligations and will not pass on additional charges without the required authorisation.

11. Complaints and dispute resolution

11.1. If you are dissatisfied with any work, goods or service, please contact us as soon as possible, quoting your invoice, job or vehicle order number.

Complaints contact: [Insert complaints email and postal address]

11.2. We ask customers to raise concerns promptly and provide a reasonable opportunity for us to inspect the vehicle, investigate the issue and propose an appropriate remedy. This request does not restrict your statutory rights or prevent you from seeking independent advice.

11.3. We will acknowledge a written complaint within 10 working days where reasonably practicable and aim to provide a substantive response within a further 15 working days. If the investigation takes longer, we will explain the reason and provide an updated timescale.

11.4. Where a complaint cannot be resolved directly, we will explain any relevant escalation or independent dispute-resolution options available to the Customer.

12. Data protection and privacy

12.1. We process personal information in accordance with applicable UK data protection law, including the UK GDPR and Data Protection Act 2018, as amended.

12.2. We use personal information where necessary to respond to enquiries, provide quotations, manage bookings, carry out work, process payments, administer warranties, handle complaints, meet legal obligations and protect our legitimate business interests.

12.3. We may share relevant information with service providers, parts suppliers, warranty providers, insurers, payment processors, professional advisers or public authorities where necessary and lawful.

12.4. We will not sell personal information to third parties for their own marketing purposes.

12.5. Marketing communications will be sent only where permitted by applicable law. Where consent is required, we will obtain it separately. You can opt out of marketing at any time using the unsubscribe facility or by contacting us.

12.6. Further information about the personal data we collect, our lawful bases for processing, retention periods, data-sharing arrangements and your rights will be provided in our separate Privacy Notice.

Privacy Notice: See link

13. Conduct on our premises

We expect customers and staff to treat each other with respect. Threats, harassment, violence and abusive behaviour will not be tolerated.

Where reasonably necessary, we may end an interaction, restrict access to our premises or contact the police. Any action taken will be proportionate and will not remove a customer's lawful rights.

14. Events outside our reasonable control

We will not be liable for delay to the extent that it is caused by an event beyond our reasonable control, such as severe weather, fire, flooding, industrial action, significant supply-chain disruption or governmental action.

We will take reasonable steps to minimise the effect of such an event and inform affected customers where appropriate. This clause does not excuse payment for work already properly completed or remove statutory rights.

15. Notices and communications

We may communicate with you by post, email, telephone or another method agreed for the relevant transaction.

Please keep your contact details up to date and notify us of any changes relevant to an outstanding booking, repair or vehicle order.

Where legislation or the contract requires formal written notice, the notice must be given in the required form and by the required method.

16. General legal provisions

16.1. No failure or delay by either party in enforcing a contractual right constitutes a waiver of that right.

16.2. These Terms and Conditions, together with the relevant quotation, job instruction, order and other agreed contractual documents, form the agreement applicable to the relevant transaction.

16.3. These Terms and Conditions are governed by the law of England and Wales, subject to any mandatory legal protections applicable to the Customer.

16.4. Any dispute will be dealt with by the courts having jurisdiction under applicable law.

16.5. Errors and omissions excepted (E&OE). This wording does not permit us to avoid our contractual or statutory responsibilities for inaccurate information.

Important customer notice: Nothing in these Terms and Conditions is intended to exclude, restrict or replace any statutory rights or remedies that apply to your transaction.
